These Terms of Use ("Terms") govern your use of the Choo Pass mobile application and related services (the "App") operated by Choo Pass ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. By using the App you represent that you meet this requirement.
Choo Pass is a crowdsourced train crossing tracker. Crossing status, predictions, and reports are generated from user-submitted data and historical patterns. The App is provided for informational purposes only.
The App is provided "as is" and "as available" without warranties of any kind, express or implied. Train crossing predictions and status indicators may be inaccurate, delayed, incomplete, or out of date. You must not rely on the App to make safety-critical decisions. Always obey posted signals, signage, and applicable traffic laws at railroad crossings. Never attempt to cross active tracks based on information in the App.
Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions are processed through Apple's App Store and are subject to Apple's Standard EULA.
You agree to submit crossing reports only when you are physically near a crossing and observing actual conditions. You will not submit false, misleading, automated, or abusive reports. We may suspend or delete accounts that violate this section.
When you submit crossing reports or other content, you grant us a worldwide, royalty-free, non-exclusive license to use, store, and display that content solely to operate and improve the App. Aggregated or de-identified report data may be retained indefinitely for the benefit of all users.
The App, including its code, logos, and design, is owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law.
Your use of the App is also governed by our Privacy Policy.
You may delete your account at any time from within the App (Account → Delete Account). Deletion is permanent and removes your authentication record and personal data associated with your account. Aggregated and de-identified report data used for predictions may be retained. We may also suspend or terminate your account for violation of these Terms.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App, including damages arising from reliance on crossing predictions or status information.
We may update these Terms from time to time. Updated terms will be posted on this page with a new "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.
